These Terms of Service and End User License Agreement (the "Terms") govern your use of the Provenance mobile application (the "App"), made by djEnterprises ("we," "us," or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Estimates, Not Appraisals — Please Read

Every identification, value, price range, grade prediction, and "should you grade this?" suggestion the App produces is an AI-generated estimate for informational and entertainment purposes only. It is NOT a professional appraisal, NOT a certification of authenticity or grade, and NOT financial, investment, or tax advice. AI can be wrong, comparable-sales data can be incomplete or out of date, and real collectible values depend on condition, authenticity, and market factors a photo cannot fully capture. Do not rely on the App's output for insurance, buying, selling, lending, tax, or other financial decisions without independent verification from a qualified professional appraiser, dealer, or grading service. You are solely responsible for any decision you make, and you use the App's estimates at your own risk.

2. License

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, in accordance with the Apple Media Services Terms and the standard Apple Licensed Application End User License Agreement (the "Apple Standard EULA"), which is incorporated by reference. Where these Terms and the Apple Standard EULA differ, these Terms govern to the extent permitted.

3. Purchases & the Provenance Pro Unlock

The App is free to download and includes a limited number of free scans. It also offers an optional Provenance Pro unlock — a one-time purchase that unlocks premium features such as unlimited scans, grade-aware pricing, an unlimited Vault, PDF exports, and batch scanning. Provenance Pro is a one-time purchase, not a subscription; nothing auto-renews and there is nothing to cancel. Payment is charged to your Apple account at confirmation of purchase, and the unlock restores across your devices via your Apple ID. Prices are shown in the App and on the App Store at the point of purchase. Refunds are handled by Apple under its policies; request one at reportaproblem.apple.com.

4. Acceptable Use

You agree to use the App lawfully and only for your own collectibles. Do not misrepresent the App's estimates as certified appraisals or official grades, do not use the App to defraud a buyer or seller, and do not attempt to disrupt, reverse-engineer, or abuse the service (including the scan backend). You are responsible for the photos and content you choose to scan and share.

5. Trademarks & Third-Party Names

Provenance is an independent product and is not affiliated with, sponsored by, or endorsed by any grading service, auction house, or marketplace. Any third-party names that appear in the App or its materials — including PCGS, NGC, PSA, PMG, BGS, CGC, eBay, and Heritage Auctions — are the trademarks of their respective owners and are referenced only descriptively (nominative use) to indicate the grading tiers or comparable-sales sources an estimate may relate to. No endorsement or partnership is implied.

6. Intellectual Property

The App, its design, its wordmark, and its generated report and appraisal-card formats are owned by djEnterprises. The photos you scan and the notes you write remain yours; the appraisal cards and reports you generate are yours to use for personal, non-commercial purposes.

7. No Warranty

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that identifications or values will be accurate or complete, or that the App will be uninterrupted or error-free.

8. Limitation of Liability

To the maximum extent permitted by law, djEnterprises and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or collectible value, arising out of or relating to your use of (or inability to use) the App or its estimates — even if advised of the possibility. To the extent liability cannot be excluded, our total liability is limited to the amount you paid for the App, if any, in the twelve months before the claim.

9. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules, except where a mandatory consumer-protection law of your place of residence applies. (Governing-law jurisdiction: Florida, USA — placeholder, subject to change.)

10. Changes

We may update these Terms from time to time. Changes are posted here with an updated date, and your continued use of the App after an update constitutes acceptance.
